President Donald Trump fired off a blistering response after President Joe Biden moved to block the release of recordings and transcripts tied to Robert Hur’s special counsel probe into classified documents, triggering fresh accusations about selective justice and transparency in Washington.

Trump’s reaction was sharp and public: “A Crooked Politician!!!” he posted on his platform, framing the lawsuit as another example of political gamesmanship. The post came as Biden asked a court to stop the Justice Department from turning over audio and transcripts to Congress and outside groups, a move that instantly raised questions about why the files remained hidden.

Biden’s lawyers argue the materials are private and should be shielded from disclosure, telling a court the release would “constitute an unwarranted invasion of President Biden’s privacy.” They stressed, “Every American, including a sitting or former Vice President, has a right to privacy in the personal conversations he has within his own home,” Biden’s attorneys wrote in the lawsuit. “And when the U.S. Department of Justice obtains that private information through a criminal investigation, the Department bears a particular responsibility to protect it from disclosure.”

The recordings at issue come from interviews Biden gave at home in 2016 and 2017 to Mark Zwonitzer, who worked with him on memoirs. Those sessions, obtained by special counsel Hur during his probe of Biden’s handling of classified materials, are now at the center of a legal fight that touches on privacy, precedent, and how the Justice Department treats powerful people.

BIDEN REPEATEDLY SAYS ‘I DON’T REMEMBER’ REGARDING CLASSIFIED DOCUMENTS IN NEWLY RELEASED HUR INTERVIEW AUDIO was a headline that circulated after excerpts leaked, and Republicans seized on the clips to demand more transparency. The transcripts already released showed moments where Biden struggled with dates and details, and that gap in memory became a political rallying point for critics who see a double standard in federal prosecutions.

BIDEN STRUGGLES WITH WORDS, KEY MEMORIES IN LEAKED AUDIO FROM SPECIAL COUNSEL HUR INTERVIEW captures the tone critics used when discussing the files, and the debate quickly split along partisan lines. Republicans point out that Hur’s final report — a 345-page document that raised questions about age and competence yet advised against charges — still left unresolved public concerns, especially when compared to the aggressive criminal case brought against Trump over similar document issues.

Hur’s investigation examined whether Biden improperly retained classified documents from his time as a senator and as vice president, and the special counsel concluded there was not enough evidence to prosecute. That legal conclusion didn’t stop conservatives from arguing the process itself was uneven: one former president faces indictment while another reportedly gets a protective legal shield and a lawsuit to block release of potentially damaging material.

The White House has also pushed back on releasing audio of Biden’s interview with Hur, and the House held then-Attorney General Merrick Garland in contempt for refusing to hand over recordings after the executive branch asserted privilege. That standoff only amplified Republican claims that the Justice Department applies different rules depending on whose side the subject is on.

Republicans are making a simple case: transparency needs to be equal across the board, not parceled out based on partisan convenience. As the court considers Biden’s bid to block disclosure, the broader fight is over whether the public gets the full record or whether standards of secrecy will be used to shield political allies from scrutiny.
