On Tuesday, President Trump’s lawyers filed a notice of appeal for Judge Tanya Chutkan’s gag order, as reported by Reuters. Upon the release of this gag order, it was determined that the scope and implications were worse than originally anticipated.
According to the order, Trump is prohibited from publicly criticizing Special Counsel Jack Smith or any other prosecutors or personnel involved in the case.
Furthermore, he is not allowed to comment on any witnesses related to the proceedings. All while Smith has been given full permission to leak information and falsehoods regarding Trump with no repercussions whatsoever.
This gag order appears to be an unconstitutional infringement on Trump’s right to defend himself against unfair accusations.
Gorsuch law clerk Mike Davis called Chutkan’s gag order “shameful” and said the DC Court was “vacate” the order.
“The DC Circuit must vacate Biden special counsel Jack Smith’s and DC Obama Judge Tanya Chutkan’s egregiously unconstitutional gag order on a criminal defendant,” Mike Davis said.
“A criminal defendant—more than anyone—must have the right to criticize the prosecutor, judge, and process,” he said.
