As Omar walked the halls of Congress recently she was asked about the scrutiny and responded directly to reporters. “Any response to what [Homan] is saying? And the public?” was the question thrown at her, and she replied, “I have no response because I don’t know what they’ll be investigating.” Those short answers left critics unsatisfied and eager for more transparency.

Sen. Ted Cruz took the next step and framed the issue in stark legal terms that Republicans like to use when calling for accountability. “If this is true, then Omar faces criminal liability under three different statutes,” said Sen. Ted Cruz, R-Texas. That kind of public spotlight from a high-profile Republican fuels calls for a formal inquiry.

The alleged legal exposure reaches across several possible charges, and GOP messaging emphasizes consequences. Federal marriage fraud, for example, is charged when someone knowingly enters into a marriage to evade immigration laws and can carry up to five years in prison, heavy fines, and deportation for noncitizens.

Republicans are also pointing to state law complications that could deepen the legal trouble if the allegations are proven. Minnesota’s incest statute is a felony with penalties that could include up to 10 years behind bars, and critics say that angle deserves full investigation given the reported family history at issue.

There are tax angles too, and conservatives say those should not be ignored as the records are reviewed. If joint tax returns were filed while a legal marriage did not exist, tax fraud charges potentially carry steep fines and prison time — another box on the list for investigators to consider.

The timeline at the center of these questions is clear and often repeated in Republican messaging to underscore the alleged pattern. Omar arrived in the United States in 1995 after receiving asylum, became a naturalized citizen in 2000, entered a religious marriage in 2002, married again in 2009 while reportedly maintaining the earlier union, separated in 2011, divorced legally in 2017, and then remarried in 2020.

Conservative critics argue that the sequence creates a credible narrative for investigators to follow, highlighting overlaps between personal relationships and possible immigration benefits. They also note that statutes of limitation could complicate prosecutions, but say that does not remove the need for a thorough probe to determine whether laws were broken and what charges, if any, are appropriate.

The fight around this story is political as much as it is legal, and Republicans have used it to press for stricter scrutiny of public officials. For conservatives pushing the issue, this is about principle and precedent: elected officials must be held to the same legal standards as everyone else. As investigators sift through records and as lawmakers keep the pressure on, Republicans say the public deserves clarity and accountability, not obfuscation.
