In July, Judge Mary Marlowe Sommer dismissed the case with prejudice, barring prosecutors from refiling the case. Nevertheless, prosecutors have the option to appeal the decision.
“A prosecutor asked a New Mexico judge to reconsider the decision to dismiss an involuntary manslaughter charge against Alec Baldwin in the fatal shooting of a cinematographer on the set of a Western movie, according to a court filing made public Wednesday.” – AP reported.
“Special prosecutor Kari Morrissey said there were insufficient facts to support the July ruling and that Baldwin’s due process rights had not been violated.” AP reported.
In July, all charges against Alec Baldwin were dropped by the judge on Friday following his defense team’s accusations of government misconduct.
Earlier in January, a grand jury indicted Alec Baldwin on charges of involuntary manslaughter related to the tragic ‘Rust’ shooting.
The previous year saw Alec Baldwin facing two counts of involuntary manslaughter in connection with the shooting death of Halyna Hutchins.

In October 2021 on the set of ‘Rust’ in Santa Fe, New Mexico, Alec Baldwin fatally shot 42-year-old Halyna Hutchins and wounded 48-year-old Joel Souza.
Following this, Baldwin’s defense team alleged that state prosecutors had hidden evidence. Surprisingly, the judge abruptly dismissed the charges during the trial.
When this occurred, Baldwin became emotional in court.
