A Massachusetts judge has denied a defense motion to throw out the murder charges against Lindsay Clancy, the Duxbury mother accused of killing her three young children.
Judge William Sullivan ruled Thursday that prosecutors presented sufficient evidence at trial to support the three first-degree murder charges Clancy faces. The ruling rejects a renewed motion for a required finding of not guilty filed by Clancy’s attorney, Kevin Reddington, on September 10 and argued before the court on Tuesday.
The case has already gone through one trial that ended without a verdict. Sullivan declared a mistrial on September 4 after the jury could not reach a unanimous decision.
During Tuesday’s hearing, Reddington, 75, challenged the evidence presented against his client, who is accused of strangling her three children with exercise bands. Sullivan found otherwise, concluding the prosecution’s case was sufficient to let the charges stand.
Clancy, 36, now continues to face all three first-degree murder charges. Thursday’s ruling marks the third time Reddington has sought to have the charges dismissed, according to reporting on the case.
