Judge Delays Release of MS-13 Member Kilmar Abrego Garcia to Prevent Deportation

A federal magistrate in Tennessee has opted to keep MS-13 member Kilmar Abrego Garcia in jail, postponing his release to avoid deportation. The Associated Press reported that concerns over his potential deportation led to this decision. Abrego Garcia faces charges related to human smuggling and is currently awaiting trial.

Abrego Garcia’s legal team argued for a delay in his release, spotlighting what they termed as “contradictory statements” from the Trump administration about his fate. In their brief, they expressed distrust in the Justice Department’s assurances, noting an ironic twist to their request. Despite a judge’s order for his release, the Justice Department announced plans to begin deportation proceedings.

Last week, U.S. District Judge Waverly Crenshaw, appointed by President Obama, ruled that Abrego Garcia should not be held while awaiting trial on federal child-trafficking charges. Judge Crenshaw is the second judge to make such a ruling. Earlier, federal magistrate judge Barbara Holmes also decided against detaining Abrego Garcia on his criminal charges.

Though ordered released, Abrego Garcia remains in custody due to Immigration and Customs Enforcement’s (ICE) intervention. The Department of Justice had communicated that once released, Abrego Garcia would be deported to a “third country,” not El Salvador. The timeline for this deportation remains unspecified by the government prosecutors.

Kilmar Abrego Garcia has entered a not guilty plea to human trafficking charges and is seeking release before his trial. Appearing in a Nashville courtroom, he wore a red jumpsuit, emblematic of his incarceration. A federal grand jury in Tennessee has indicted him for transporting undocumented migrants within the U.S.

The indictment includes one count of conspiracy to transport aliens and another for unlawful transportation of undocumented individuals. The charges allege that Abrego Garcia and his partners from El Salvador, Guatemala, Mexico, and the U.S. were involved in trafficking illegal immigrants from 2016 to 2025. The government warns that if convicted, he faces up to 10 years in prison for each individual transported.

According to ABC News, a co-conspirator implicated Abrego Garcia in the murder of a rival gang member’s mother. This new detail adds gravity to his already serious charges. In a separate incident, Fox News obtained bodycam footage showing Abrego Garcia caught in the act of human trafficking in Tennessee in 2022.

The footage shows law enforcement confronting Abrego Garcia, leading to a call to Biden’s FBI, which reportedly advised releasing him. Similarly, Biden’s ICE failed to make an appearance, as per Fox News reports. This incident underscores long-standing issues with immigration enforcement and policy.

Conservative commentators have used this case to highlight perceived failures in immigration policy under the Biden administration. The footage has rekindled debates about the effectiveness of current immigration enforcement. Critics argue that this case exemplifies the need for stronger border policies.
