The House GOP is pushing a bill to bar Dr. Anthony Fauci from ever holding federal office again after a contentious Capitol Hill hearing where he repeatedly invoked his Fifth Amendment rights; Republicans frame this as restoring accountability and preventing officials who dodge congressional oversight from returning to power.
The Republican response was swift and pointed after Dr. Fauci’s appearance before the Senate Committee on Homeland Security and Governmental Affairs, chaired by Sen. Rand Paul. GOP lawmakers say the hearing exposed a pattern of evasion that cannot be brushed aside if government is to answer to the people. That reaction led Rep. Rich McCormick to introduce legislation aimed at making refusal to cooperate with Congress disqualifying for future federal service.
McCormick frames the bill as common-sense accountability. He compared pleading the Fifth in a congressional setting to pleading ignorance at a job when your cash drawer is short, saying, “We saw him evade so many questions, pleading the Fifth… that’s fine, that’s your constitutional right,” and “It should be the same way in government. If you don’t want to answer questions about what you did wrong, we should be able to fire you.” Republicans argue that constitutional rights do not create a shield against employment consequences in public office.
Called the STOP the SWAMP Act, the proposal would bar people from federal employment if they refuse to answer certain questions from lawmakers or if they are convicted of perjury. The bill also includes provisions to allow congressional referrals for prosecution when witnesses unlawfully withhold information. The central point from GOP sponsors is straightforward: public servants owe transparency to Congress and the American people, and penalties should follow when that duty is neglected.
Sen. Paul, who led the questioning, has signaled his committee will explore contempt proceedings following the testimony. Republicans are treating this as more than a political stunt; they present it as an institutional fix to deter future stonewalling. For leaders who wield significant influence over public health policy, GOP lawmakers insist there must be consequences when oversight is short-circuited.
The hearing came on the heels of newly released diary entries that renewed scrutiny of Fauci’s role during the pandemic and his influence on policy decisions. Some passages were cited by critics as evidence he privately took credit for driving lockdowns and school closures, even as he publicly denied such responsibility. Fauci told the House Oversight Committee in January 2024, however, “I did not close the schools.”
Republicans point to a broader problem they see in the federal bureaucracy, where officials can exert massive, sometimes secret, power without accountability. The proposed legislation aims to prevent those who refuse congressional oversight from simply returning to similar roles later. GOP backers say accountability bills are necessary to restore trust and to keep decision-makers answerable to elected representatives.
Fauci is not currently charged with any crime and he denies wrongdoing, but the political fallout is real and immediate. The GOP push is less about personal vendetta and more about setting a precedent that public servants must face consequences when they refuse to cooperate with Congress. On the Hill, party leaders are positioning the measure as a way to protect the system of checks and balances and to deter evasive conduct in future hearings.
The debate is now likely to move from headlines into committee rooms, where legal questions and political calculations will collide. Republicans will press to codify a standard that says the right to remain silent does not translate into a free pass for public employment. For GOP lawmakers, the objective is clear: ensure that those who make powerful decisions for the country remain accountable to the people through their representatives.
