On Thursday, President Joe Biden made a ton of false and/or misleading statements as he revealed his gun-control executive actions.
Biden falsely stated that though someone who buys a gun at a gun store has to go through a federal background check, there is an exemption for sales made at gun shows. That is an out and out lie. I have been to gun shows and you have to go through the background check. Almost every person selling guns at gun shows is an FFL dealer. Anyone who sells a gun at a gun show without doing a background check is breaking the law.
“Most people don’t know, you walk into a store and you buy a gun you have a background check,” Biden said from his perch at the White House. “But you go to a gun show, you can buy whatever you want and no background check.”
The problem I have with this kind of nonsense is that there are now probably millions of Americans who don’t know that what Biden said is a lie. They probably never thought about it either way, but now they have a frame of reference on it and based on Biden’s lie.
Federal law has never regulated gun sales based on where the sale takes place. How absurd. Federal law regulates gun sales based on who is involved in the sale, the buyer, and the seller. You could be in the back of the Scooby-Doo Mystery Van buying a gun and you still have to go through a background check. Read the law here.
If a private citizen sells his own “used” firearm, to another private citizen inside their own state, federal law does not require a background check to be done. HR-8 now wants to require states to do this, and I think it’s unconstitutional. I don’t think the federal government has the right to do any background checks because of the Second and Tenth Amendments. I don’t understand why so many politicians have a problem knowing what “…the right of the people to keep and bear arms shall not be infringed” means.
Another lie Biden told was when he declared that the gun industry has special protection from all liability. This was when he pushed for the repeal of the Protection of Lawful Commerce in Arms Act.
“People don’t realize the only industry in America, a billion-dollar industry that can’t be sued, that are exempt from being sued, are gun manufacturers,” Biden said. “This is the only outfit that is exempt from being sued.”
That is another flat-out lie. Gun manufacturers enjoy no such exemption and can be sued, in fact, they are all the time, normally over claims of negligence.
Think about this. If gun manufacturers were exempt from lawsuits, then how was Remington sued and they settled on a case over an alleged design flaw with the trigger on its Model 700 rifle, which is a very popular rifle? I thought Biden said they couldn’t be sued?
Sig Sauer was sued numerous times over an alleged safety defect with its P320 handgun. How is that possible if Joe Biden told the truth? He lied.
Here’s how Biden pulled off this lie about exemptions. When he pushed for the repeal of the Protection of Lawful Commerce in Arms Act, he made an effort to make people believe that gun manufactures can never be sued, but that exemption doesn’t give them blanket immunity. It gives immunity to the gun manufacturing industry from lawsuits that arise from criminal misuse of guns by third parties. In other words, Biden wants a gun manufacturer to be sued when a criminal uses one of their guns to commit a crime. What’s next, suing automobile manufacturers when someone dies in a legitimate accident? A company that makes baseball bats should be sued if someone uses a bat to beat someone to death? You see where I’m going.
Biden used the tragedy of the Charleston church shooting by Dylann Roof in 2015 to spread misinformation in order to push for the Senate to take up HR 1446, which extends the amount of time the FBI can delay a gun sale. The Liar-in-Chief was talking about the existing three-day limit for doing a background check. Dylann Roof purchased his gun that he used to do the church shooting after the FBI failed to conduct his background check within the three-day limit.
“What happened is someone was allowed to get the gun used to kill those innocent people at a church service,” Biden said. “If the FBI didn’t complete the background check within three days. There was a process. I did not do if it in three days, according to the Charleston loophole, you get to buy the gun.”
This is such a bullschtein story. Biden is acting like extending the delay period could have changed the outcome of the church shooting. Roof was an evil, racist nut who was going to shoot up that church no matter what, and no length of delay was going to stop him. It is disingenuous and a disservice to the innocent people who died that day by Biden spreading misinformation like that. And so far, no mainstream media outlet has held him accountable for it.
At a press briefing after Biden’s comments, White House press secretary Jen Psaki clarified his remarks on background checks at gun shows.
“No it’s not his belief,” Psaki responded when asked if Biden thought there was a special exemption in federal law for background checks. “He believes that background checks should be universal,” even though that’s not what he said. You will never get truth and transparency from this administration.
