Federal Judge Accused of Conflict of Interest After Ruling Against Trump’s Funding Freeze

President Donald Trump is rapidly implementing the pledges he made during the 2024 campaign to streamline government operations and eliminate what he describes as “waste, fraud, and abuse.” However, his efforts are being challenged by a coalition of Democrat-led states and various non-profit organizations.

Almost every day, there’s a new legal action taken against his administration, with restraining orders and mandates to reinstate dismissed employees being issued regularly.

In a recent development, evidence has emerged suggesting that the federal judge overseeing a significant case against Trump’s policies may have a conflict of interest. This particular case revolves around Trump’s decision to temporarily halt federal funding, a move that was contested by 22 states and the District of Columbia. Chief Judge John McConnell of the Rhode Island federal district court had ordered a stop to the funding freeze in January.

On February 10th, Judge McConnell ruled that the Trump Administration had not adhered to his order, demanding that the funds be unfrozen as legal proceedings continued. In his order, McConnell stated, “persons who make private determinations of the law and refuse to obey an order generally risk criminal contempt.” The lawsuit, highlighted by America First Legal, was filed by 22 states as part of a “secret Blue State resistance” strategy.

America First Legal has raised concerns about Judge McConnell’s impartiality, noting his involvement with a non-governmental organization that receives substantial federal funding. This NGO, Crossroads Rhode Island, is a sub-awardee of multiple federal grants from agencies such as the Department of Agriculture and Health and Human Services. Judge McConnell’s longstanding association with Crossroads, where he served as Chairman from 2011 to 2021, raises questions about a potential conflict of interest.

Screenshots of Crossroads’ 2023 financial filings reveal that McConnell is still listed as a member of the Board. Since joining the board in 2006, Crossroads Rhode Island has reportedly received over $117 million in government funding. America First Legal suggests that if fiscal years 2024 and 2025 are considered, this figure reaches $128 million.

The organization stated that federal funds typically flow to states, which then distribute them to NGOs like Crossroads Rhode Island. When Judge McConnell mandated continued federal funding for Rhode Island, it effectively ensured ongoing support for Crossroads, an entity he is closely associated with. This situation seems to violate federal law, specifically 28 USC § 455, which requires judges to recuse themselves from cases where their impartiality could be questioned.

According to 28 USC § 455 (b)(4), a judge should disqualify himself if he or his immediate family have a financial interest in the case. America First Legal argues that McConnell’s continued involvement with Crossroads presents such a conflict. The organization emphasized that directors of non-profits have fiduciary duties, and the appearance of neutrality is crucial for fair justice.

The legal community is now scrutinizing Judge McConnell’s decision to preside over a case with such apparent personal ties. America First Legal has called for his immediate recusal, stating that his financial interests could be substantially affected by the case’s outcome. They argue that impartiality is a cornerstone of judicial integrity.

This revelation comes amid a broader legal battle faced by President Trump, with over 40 lawsuits having been filed against him since assuming office. These lawsuits are part of a coordinated effort by Democrat attorneys general to challenge his policies.
