Lately, it feels like there’s always news about federal judges throwing obstacles in the path of the Trump administration. A lot of these stories don’t seem to favor the administration, and it’s frustrating for many. While some folks, including myself, remain hopeful that these issues will eventually be resolved in favor of the administration, the current situation is undeniably challenging.
Most of us are holding on to optimism, believing that things will eventually work out well for the administration and the country. Whenever there’s a glimmer of good news from the judiciary, it’s a moment worth appreciating.
Recently, there was a positive development when Chief Justice John Roberts issued an order in a case involving Freedom of Information Act (FOIA) requests related to the Department of Government Efficiency (DOGE). This brief order temporarily halted discovery into whether DOGE is a government agency subject to public records requests. It’s a small but significant victory.
Here’s a bit of background: On February 20, Citizens for Responsibility and Ethics in Washington (CREW) filed a lawsuit against DOGE, Elon Musk, and other government entities. They claimed various shady activities and sought to have DOGE declared an “agency” under U.S. law, making it subject to FOIA requests. Judge Christopher Cooper, an Obama appointee, granted part of CREW’s motion for a preliminary injunction on March 10.
By April 15, Judge Cooper had ordered expedited discovery in the case. The Trump administration quickly appealed this decision, arguing that DOGE is an advisory body, not an agency, and shouldn’t be subjected to these requests. An administrative stay was granted by the D.C. Circuit on April 18, but it was later dissolved on May 14.
Subsequently, Judge Cooper denied the administration’s motion for a stay, allowing discovery to proceed. On May 21, the administration filed an application for a stay in the Supreme Court, leading to the Chief Justice’s recent order. This move by the Supreme Court is a temporary win, though the ultimate outcome remains uncertain.
It’s important to note that while this decision is a step in the right direction, it’s not a final victory. The Supreme Court’s involvement and pause on the discovery process are positive signs, but the administration still faces challenges ahead. The D.C. Circuit’s previous actions suggest that the final decision could go either way.
For now, this pause provides a moment of relief, even if it’s temporary. The fact that the Supreme Court is taking a closer look at the matter is encouraging. As we head into a holiday weekend, it’s worth keeping an eye on any unexpected decisions that might emerge from the court.
