California Issued CDL To Alleged Illegal Driver, Oregon Fatalities

An Oregon highway crash that killed two people has become a flashpoint in the debate over immigration policy after federal officials said the truck driver was an undocumented Indian national who was allowed into the country and later issued a commercial driver’s license in California under Governor Gavin Newsom, and work authorization by the Biden administration; ICE has lodged a detainer while state sanctuary policies complicate custody and enforcement.

The driver, identified by federal authorities as Rajinder Kumar, is accused of criminally negligent homicide and reckless endangerment after his semi-truck jackknifed and a Subaru Outback struck the trailer, killing the vehicle’s occupants. Local law enforcement says the wreck blocked both lanes of U.S. Highway 20 late at night, creating a chaotic scene that first responders had to secure. Families of the victims are grieving while federal officials are pressing for accountability.

DHS has said Kumar entered the United States illegally near Lukeville, Arizona, in November 2022 and was subsequently released into the country by federal authorities. The agency also stated that he was issued work authorization in 2023 and later obtained a commercial driver’s license issued in California. Those details have prompted sharp questions about how driver vetting and immigration releases are handled.

Immigration enforcement sources confirm ICE has lodged a detainer for Kumar, and he remains held at the Deschutes County jail pending criminal proceedings. Officials noted custody questions are complicated because Oregon is considered a sanctuary state, making transfer to federal custody less straightforward. As DHS put it, “since Oregon is a sanctuary state, ICE will make all necessary efforts to bring Kumar into custody should he be released from custody.”

This crash is being linked to a string of incidents in which undocumented drivers licensed in sanctuary or permissive states have been implicated in deadly collisions. Federal officials point to past cases involving semi-trucks that resulted in multiple fatalities and life-altering injuries, arguing those examples show a pattern that needs to be fixed. Republican leaders are seizing on the pattern to push for stricter checks and coordinated enforcement across state lines.

DHS Assistant Secretary Tricia McLaughlin issued a statement that begins with a personal note about the victims: “Our prayers are with William and Jennifer’s families.” That was followed by a pointed political critique: “Rajinder Kumar, a criminal illegal alien from India, was released into our country under the Biden administration and issued a commercial driver’s license by Gavin Newsom’s Department of Motor Vehicles. How many more senseless tragedies must take place before sanctuary politicians stop allowing illegal aliens to dangerously operate semi-trucks on America’s roads?” said McLaughlin. “Under Secretary Noem, ICE will continue its efforts to get illegal alien truck drivers off America’s highways.”

Republican critics say the case highlights failures at every level: a porous border that allowed an entry without sustained detention, administrative policies that granted work papers, and state-level licensing that created the opportunity for commercial driving. They argue those combined failures risk public safety and demand immediate reforms to licensing, background checks, and cooperation between federal and state agencies. Calls are growing for clearer rules to prevent similar tragedies.

Democratic officials who oversee state licensing and sanctuary policies argue their priorities differ and that due process must be respected, but the collision has put pressure on those leaders to explain how licenses and commercial credentialing are issued. Traffic safety advocates point to the unique hazards posed by heavy commercial vehicles and urge stricter oversight for any driver hauling large loads. Meanwhile, prosecutors must handle the criminal case while federal authorities pursue immigration remedies.

ICE’s detainer marks the start of a parallel enforcement track that could result in removal proceedings if the individual is found removable under immigration law and if custody can be transferred. That process can take months and may be affected by state-level resistance to federal holds, legal challenges, and the outcome of criminal trials. For now, the focus remains on supporting victim families and preventing repeat tragedies through policy fixes Republicans argue are long overdue.

The tragedy has prompted renewed debate about who decides which drivers are allowed on America’s highways and which government entities bear responsibility when things go wrong. Political leaders on the right are using the episode to press a familiar case for tighter border control, stricter immigration vetting, and stronger cooperation between states and federal agencies. Families mourning lost loved ones are left hoping the next hours and policy fights deliver some measure of safety and justice.
